Dawn Richard's Lawsuit Against Diddy Dismissed by Federal Court

Dawn Richard's lawsuit against Diddy has been dismissed in Federal court, but she may pursue claims under New York's Gender-Motivated Violence Act in state court.

Diddy has achieved a significant legal victory today as a Federal court dismissed the lawsuit filed against him by Dawn Richard. According to reports from TMZ, Judge Katherine Polk Failla determined that all 18 claims presented by Richard could not proceed at the Federal level for several reasons.

The ruling did not address the validity of Richard's allegations; instead, it focused on procedural issues that prevented the case from moving forward. Specifically, 15 of Richard's allegations were deemed to be beyond the statute of limitations. Additionally, two claims related to the song "Deliver Me" were dismissed due to copyright complications. The judge also indicated that the claim of gender-motivated violence should be addressed in state court rather than in Federal court.

Despite the dismissal, the judge provided a potential path forward for Richard by suggesting she could utilize New York City's Victims of Gender-Motivated Violence Act. This legislation allows women to take legal action irrespective of the amount of time that has elapsed since the alleged incidents occurred. Richard's legal team has indicated that they plan to pursue this option as their next step.

Attorney Arick Fudali of The Bloom Firm expressed disappointment in the dismissals but conveyed optimism regarding the court's decision not to dismiss the case with prejudice. He stated, "We’re certainly disappointed in the dismissals. However, we’re very encouraged that the judge chose not to dismiss with prejudice and basically just refer the Gender Motivated Violence Act claim to state court. We feel very confident in the Gender Motivated Violence Act claims. We believe those are our primary claims anyway. We’re encouraged with the ability to pursue our Gender Motivated Violence Act claims in state court."
